The Fair Work Act (Cth) 2009 commenced operation on 1 July 2009, with additional provisions, including those relating to Modern Awards and the National Employment Standards (“NES”), commencing on 1 January 2010.
Modern Awards have been created to simplify the national system of awards and apply to industries and occupations including the Legal Service Award 2010.
The NES cover 10 minimum conditions which all national system employees are entitled, including maximum working hours, annual leave, personal leave, parental leave and flexible working arrangements. Employers must ensure that existing contracts, policies and procedures are updated to reflect the obligations under the NES and any applicable Modern Awards.
In additional to the creation of Modern Awards and the NES, the Fair Work Act also introduced changes to the unfair dismissal regime. Many more employers must now comply with unfair dismissal obligations before effecting the termination of their employment.
In this session Paul Werner, State Director - Victoria Fair Work Ombudsman and Paul Ronfeldt, Partner, Russell Kennedy will explain "everything you need to know" in plain English.
